TERMS AND CONDITIONS OF CONTRACT
1. Introduction
These terms and conditions apply to the sale to you by Rokeby of any limited edition print or any other piece of artwork by any artist either at the Rokeby premises or through its website.
2. Orders and Prices
2.1 Edition prices are subject to change. As is traditional in edition publishing, prices may rise as the edition begins to sell out.
2.2 Once your order has been placed we can offer purchasers equivalent prices in sterling and US Dollars, while every effort is made to keep these prices as accurate as possible, the nature of currency exchange means that the equivalents may be out by a small percentage.
2.3 Please note that we cannot reserve inventory for fulfillment of orders until we receive payment, unless agreed with the gallery.
3. Payment
We currently accept payment by cheque (in GBP sterling) made payable to Rokeby (London) Limited. Please write your name, address, card number and expiry date on the reverse of the cheque. Please note that your purchase will not be dispatched until the cheque has been received and funds have cleared. Alternatively you can transfer funds in our account (details available on request). Please note that foreign currency cheques and bank transfers (BACS) are subject to bank charges which must be paid in full by the sender, and that transfer of title does not occur until the invoice is paid in full.
4. Tax
3.1 If you live in the UK or European Union, All sales will be subject to sales tax (VAT of 17.5%).
3.2 Purchases exported to non-EU countries will be not be subject to VAT, proof of export is required. Shipping can be arranged by the gallery.
3.3 It is possible to reclaim VAT on items purchased from, and removed from, the gallery which are subsequently exported. Please note that this is the responsibility of the purchaser or their nominated shipper.
3.4 There is no VAT on publications
5. Delivery
5.1 Once your order has been shipped we will contact you (where applicable) with relevant tracking numbers. Please note that postage and packing/shipping is not included and may be subject to an additional charge, overseas customers will have to pay shipping and any customs fees.
5.2 Delivery charges are based on packaging costs plus charges set by shipping companies. These charges are calculated from your shipping address, the weight of the package to be delivered and the value. Postage and packaging will be added to the total of your bill. You will be provided with the postage charge when we first contact you about your order.
5.3 Please allow up to 14 days from receipt of payment for your order to be packed and shipped. If you require a more rapid delivery on a specific date, please telephone +44 20 7193 5034 and we will endeavor to meet your needs.
5.4 Alternatively work can be collected from the premises at the time of purchase or at any other date and time so agreed.
6. Title and Risk
Title and risk in the Artwork shall pass to you when the Rokeby has received the payment price for the Artwork in full, in cash or in cleared funds, whether or not delivery has been made. Upon such payment, you will be responsible for the Artwork, the risk of damage to or loss of the Artwork will pass to you and you shall be responsible for insuring the same.
7. Authenticity
All unique works will be signed by the artist, or in some cases a Certificates of Authenticity will be provided. Most Editions will be signed and numbered by the artist. Certificates of Authenticity are available on request.
8. Data protection
Rokeby is firmly committed to respecting your privacy. We do not share your details with any third party.
We do not store credit card details nor do we share customer details with any 3rd parties
9. Liability of Rokeby
11.1 Except in respect of death or personal injury caused by the Rokebyís negligence, Rokeby shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of Rokeby, its employees, agents, sub-contractors or otherwise) which arise out of or in connection with the sale of the Artwork or its use by you and the entire liability of the Rokeby under or in connection with the sale of the Artwork to you shall not exceed the total sum paid under the invoice for the Artwork.
11.2 Rokeby does not accept any liability for damage to the Artwork caused by your own negligence or fault, in particular, but not restricted to, in the maintenance of the Artwork.
10. Returns
If your purchase arrives damaged please retain all packaging and paperwork and contact Rokeby immediately. All work purchased online or from the gallery is sold as seen. Refunds due to damage in transit will depend on method of transport and the corresponding insurance criteria. Refunds for any other reason are only offered at the discretion of Rokeby. Returns will only be considered within 7 days from purchase date.
11. Waiver
No failure or delay by Rokeby in exercising any right, power or privilege shall impair the same or operate as a waiver of the same, nor shall any single or partial exercise of any right, power or privilege preclude any further exercise of the same or the exercise of any other right power or privilege. The rights and remedies provided in these Terms and Conditions are cumulative and not exclusive of any rights and remedies provided by law.
12. Severance
If any provision of these Terms and Conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from these Terms and Conditions and rendered ineffective as far as possible without modifying the remaining provisions of these Terms and Conditions, and shall not in any way affect any other circumstances of or the validity or enforcement of these Terms and Conditions.
13. Intellectual Property
All copyright in the material contained on the website and any trademarks and brands included in that material belong to Rokeby or its licensors.
14. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with English law and the parties irrevocably submit to the non-exclusive jurisdiction of the English courts.
Nothing contained in these Terms and Conditions affects your statutory rights.
